Yes, we can still pursue a claim, although our approach to the case will be different. In lending cases where the original lender is no longer solvent, we typically seek compensation through the lender’s insurer, administrators, or the Financial Services Compensation Scheme. For fraud, we may be able to trace funds to the receiving banks or payment processors and seek recovery from them. Whatever the situation is, our expert consumer law solicitors will explore every possible avenue and make sure you understand the options clearly before proceeding.
It depends on the type of consumer protection claim. For example, a straightforward case of unfair lending, which we’re able to handle via the lender’s internal complaints process, may take between four and six months to resolve. Cases that require a referral to the Financial Ombudsman Service can take longer – typically between six months and a year to complete. For more complicated fraud cases, especially those requiring court action, the timeline can stretch beyond a year. We’ll do our best to give you a realistic estimate of the time needed once we understand the details of your case.
We handle all of our consumer claims and fraud/scam cases on a no-win, no-fee basis, so there are no upfront fees for you to pay, and no legal costs if your case is unsuccessful. If we win the case on your behalf, we’ll deduct our fee from the compensation that is awarded – always agreed in advance and capped according to current regulations. Before you decide to go ahead with a case, you’ll receive a clear summary of the terms and the fees that will apply in the event of a win, so there are no surprises in store.
If your case is related to unfair lending, we’ll usually need to see copies of the credit agreement, account statements, and any correspondence between you and the lender, such as letters, emails, or text messages. If you’re missing any documents, don’t worry – in most cases, we can obtain copies from banks or lenders if needed. For fraud and scams, useful evidence includes messages, chat logs and emails, as well as screenshots of relevant webpages, and references from Action Fraud or the police if these agencies are already involved.
No, challenging an unfair loan should not have an impact on your credit file; in fact, it’s more likely that it will result in an improvement if negative markers are removed as a result of a successful case. And taking legal action should not negatively affect your relationship with your bank, which may be a concern if you wish to continue as a customer. Under UK consumer law, banks are obliged to treat victims of fraud fairly, and using legal representation should not impact ongoing services. If you do encounter any pushback, we’ll address it on your behalf.
